What should I check before moving abroad?
Review immigration permission, personal tax, work arrangements and ownership separately. A residence card answers only part of that picture. Build a dated plan with advisers in the countries that will remain connected to you.
Residence permission, tax residence and citizenship are different
Residence permission concerns your right to stay and the activities permitted by that status. Tax residence determines how a country’s tax rules apply to your circumstances. Citizenship is nationality, with a separate application and legal test. Do not use one status as proof of another.
Residence in one European country also does not automatically establish the right to move to or work in a second country. EU rules give some categories additional mobility rights, but the conditions still need checking. European Commission: residence and movement between EU countries.
When could Portugal treat me as tax resident?
Two important Portuguese tests are spending more than 183 days in a 12-month period beginning or ending in the tax year, or having a home that indicates an intention to keep and occupy it as a habitual residence even with fewer days. The legislation includes start/end-date rules and other cases. Assess each person separately; this is not a universal calendar-year day-count rule. Portuguese Tax Authority: Article 16.
Portuguese tax residents are generally within the scope of income tax on income from Portugal and abroad; non-residents are generally within scope on Portuguese-source income. Part-year residence has specific treatment. This describes the starting scope, not the final tax bill, exemptions or treaty outcome. Portuguese Tax Authority: Article 15.
Example: a shorter stay still needs review
A person plans 150 days in Portugal and keeps a home available there. The day count alone cannot settle the result: the home and the intended living arrangements also need reviewing. This is an illustration of the question to ask, not a conclusion about that person’s tax residence.
Which records make the tax review useful?
- A dated travel calendar for each person, including overnight stays.
- Homes available to the household and how each will be used.
- Employment, company roles, pensions, rental income and anticipated disposals.
- Current tax registrations, prior returns and any treaty position already taken.
Have the relevant advisers consider both countries’ domestic rules and the applicable treaty. Record what filings or elections are needed, the dates they take effect and who is responsible. Do not assume a relief applies merely because income is taxed abroad.
What changes for a U.S. citizen or resident alien?
Moving abroad generally does not end U.S. tax on worldwide income. Foreign-account reporting can also apply even when an account produces no taxable income. Exclusions and credits have conditions and filing requirements. IRS: U.S. citizens and resident aliens abroad; IRS: foreign tax credit.
Can I keep managing my existing company?
Review the company as well as the owner. Portugal’s corporate tax code treats an entity with its registered office or effective management in Portugal as resident for that code. Changing where decisions are made can therefore raise a separate question from changing the owner’s address. Portuguese Tax Authority: corporate residence, Article 2.
Before moving a company, trust or assets, prepare an ownership diagram and a list of decision-makers, beneficiaries, accounts, property and planned transactions. Ask advisers how the arrangement is treated in each country, whether reporting changes and what an eventual sale or unwind would involve. A structure that is useful in one country should not be assumed to have the same treatment elsewhere.
What should a family plan cover?
Separate the timetable into permissions, everyday life and administration. Confirm each person’s residence and work position before fixing school or employment dates. Check healthcare cover, school admissions, housing and document requirements directly with the organisations involved. A family relationship alone is not a substitute for the required permission. Keep citizenship planning separate. Do not build a move around an assumed passport date or treat an investment as a citizenship guarantee. Current nationality requirements should be checked when a relevant application is being considered.
What should I bring to the first conversation?
- A one-page summary of who would move, their nationalities and the reason for the move.
- A tentative calendar showing homes, travel, employment and school plans.
- An outline of income and ownership categories, without sending confidential statements at the enquiry stage.
- A question list divided into immigration, tax, work and family matters.
- The names of any advisers already engaged and the decisions still awaiting their input.
